This policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Our Intellectual Property

All content available on christmastoolkits.ibitola.com and within our Products — including but not limited to templates, designs, layouts, graphics, text, logos, icons, images, and digital files — is the proprietary intellectual property of Christmas Command Center™ and iBitola, protected by United States and international copyright laws.

Unauthorized reproduction, distribution, modification, public display, or creation of derivative works from our Products or Site content is strictly prohibited and may result in legal action.

2. Reporting Copyright Infringement

If you believe that any content on our Site or within our Products infringes upon your copyright, you may submit a DMCA takedown notice. Your notice must include the following information as required by 17 U.S.C. § 512(c)(3):

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or — if multiple works are covered by a single notice — a representative list of such works.
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate the material on our Site (e.g., specific URLs).
  4. Your contact information: full name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

3. Where to Send DMCA Notices

Please send DMCA takedown notices to our designated Copyright Agent:

4. Counter-Notification Process

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Delaware if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or customers who are deemed to be repeat infringers. We may also limit access to the Site and Products for any user who infringes the intellectual property rights of others, regardless of whether repeat infringement has occurred.

6. Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material or activity was removed or disabled by mistake or misidentification — may be subject to liability, including costs and attorney's fees.

7. Protecting Our Products

We actively monitor for unauthorized distribution of our Products. If you encounter our Products being shared, resold, or distributed on third-party platforms (including but not limited to Etsy, Gumroad, social media, file-sharing sites, or membership platforms), please report it to us at [email protected].
